General Terms and Conditions (GTC) – Kitesurf & Paddle ApS

1. Participants and Rental Eligibility

Participation in courses and equipment rental is open to any person who is physically fit and capable of practicing kitesurfing, SUP, kayaking, wing surfing, or sailing without putting themselves or others at risk.To take part in any kitesurfing, SUP, kayaking, wing surfing, or sailing course, or to rent equipment for these activities, participants must be able to swim in open water for at least 15 minutes without aids. Minors require the consent of a parent or legal guardian.

 

 

2. Registration/ withdrawal from the contract

  1. Registration for a kitesurfing, SUP, kayaking, wing surfing, or sailing course / event / camp must be made in writing (including online registration forms). The same applies to rental agreements. For minors, written consent from a parent or legal guardian is required for the agreement to be valid.

  2. Cancellation must be made in writing. If cancellation is made later than 14 days before the start of a course or rental period, 30% of the respective price will be charged unless a replacement participant or renter is provided. If cancellation of our watersports camps or event weeks is made later than 30 days before the start, 50% of the respective camp/event price will be charged unless a replacement participant is provided.

  3. The surf school reserves the right to withdraw from the contract without notice if the required minimum number of participants for a course, event, or camp is not reached. The same applies in cases of force majeure (e.g. strong winds, lightning) or if kitesurfing, SUP, kayaking, wing, or sailing equipment is damaged or destroyed due to collisions or vandalism. Payments already made will be refunded. No further claims can be made.

  4. Participants who significantly disrupt a course, act in breach of the agreement, or deliberately endanger themselves or others may be excluded from further participation.

 

3. Duty to Cooperate

In the event of any disruption, the participant is required to do everything reasonably possible to help resolve the issue and to keep any potential damage as low as possible.

 

 

4.  Safety / Conditions of Operation

  1. Instructions given by the instructor or rental provider must be followed. Glasses must be secured against loss.

  2. If a course, rental, or tour cannot be carried out due to weather conditions, the customer is not entitled to a refund. The outstanding service will be credited and can be carried out at a later date.

 

 

 

5. Duty of Care

  1. The safety and proper condition of kitesurfing, SUP, kayaking, wing, and sailing equipment are ensured through regular inspections. However, the participant/renter is required to check the equipment before use.

  2. In the interest of all parties, any damage must be reported immediately.

  3. If the equipment is no longer safe to use due to failure to follow instructions or due to negligent or intentional behavior by the participant/renter, there is no entitlement to compensation for any time lost due to inspection or repair.

 

 

6.  Liability

  1. Kitesurf & Paddle is responsible for the proper preparation of courses and events, the careful selection and supervision of service providers, the accuracy of course descriptions, the correct delivery of agreed services, and the proper execution of inspections to ensure equipment safety.

  2. Liability for personal injury and property damage is excluded.

  3. Participants/renters are required to report any damage caused by themselves or others. They agree to handle and operate all equipment with care.

  4. Participants/renters are personally liable for any damage they cause (including downtime and consequential damage) to kitesurfing, SUP, kayaking, wing, or sailing equipment.

  5. No liability is accepted for loss of valuables, glasses, money, or other personal belongings.

 

 

7.  Additional Rental Conditions

  1. Kitesurf & Paddle ApS, as the rental provider, is entitled to refuse to hand over equipment if the renter does not have the required qualifications.

  2. If, after handover, it becomes apparent that the renter lacks sufficient skills (e.g. inability to control the equipment, violation of navigation or safety rules, or endangering others), or if they act against instructions, the rental provider may terminate the contract immediately and retain the rental fee.

  3. The renter is required to return the equipment on time. Weather conditions must be taken into account and do not justify late return.

  4. The renter is liable for all damages and costs resulting from late return.
    Furthermore, the renter is fully responsible to the rental provider for all obligations arising from the rental agreement. The renter is also responsible for any fault or negligence of co-users.

 

 

8. Severability Clause

If any provision of this agreement is invalid, the validity of the remaining provisions shall not be affected. The parties agree to replace any invalid provision with one that most closely reflects the intended purpose.
